Filing for divorce in Minnesota involves several important steps that help the process move smoothly. Understanding these steps can prepare you for what’s ahead and make navigating the process easier.

Determine residency requirements

Before you file for divorce, you or your spouse must meet certain residency requirements. One of you must have lived in the state for at least 180 days before filing. If neither of you meets this requirement, you’ll need to wait before initiating the divorce process.

File a petition for divorce

The next step is to file a “Petition for Dissolution of Marriage” with the court. This document outlines the reasons for seeking the divorce, including any issues regarding children, property, and spousal support. After you file the petition, you must serve it to your spouse, notifying them of the divorce action.

Serve the divorce papers

Once you file the petition, you must serve the papers to your spouse. You can do this in person or by mail. This step informs your spouse about the divorce and gives them a chance to respond. You may also need to file a Certificate of Service to show the court that your spouse received the papers.

Respond to the divorce petition

Finalize the divorce

After you and your spouse settle all issues, a judge will issue a final decree of divorce. This document ends the marriage and outlines the terms of the divorce, including custody arrangements, property division, and support obligations. Once the judge signs the decree, you are legally divorced.
